Experience
Mr. Diamond has extensive litigation, mediation and arbitration experience.
As a Litigator, Mr. Diamond has litigated a wide variety of cases involving personal injury including, but not limited to, wrongful death, serious automobile accident cases including amputation, dog-bite cases, slip and fall cases, motorcycle accident cases and auto-pedestrian cases.
He has served as a Judge Pro Tem in Marin County; and has been recommended as a mediator by all major casualty and commercial liability insurance carriers as well as numerous plaintiffs’ attorneys.
Since 2000, he has mediated in excess of 2000 cases, including but not limited to, personal injury, real property and probate litigation matters.

Mediation Fee Schedule 2024
Standard mediations are set for half or full day sessions
Half Day Rates consist of four (4) hours inclusive of review and preparation time, additional time is billed at $550 per hour
Full Day Rates consist of eight (8) hours inclusive of review and preparation time, additional time is billed at $550 per hour
Payment for Mediator Services and Retainer Agreement
The fees for services, other than mediation session time, include but are not limited to, the review of submitted materials, post-session continued mediation work, which is often conducted telephonically or electronically, and intersession review of additional materials as needed.
Payment of all fees should be made no later than five (5) business days before the commencement of the session.
The mediator reserves the right to cancel the mediation if the requisite mediation fees are not timely paid.
All parties represented by the same attorney or firm are considered a single “party”
Cancellation or Rescheduling Policy
A cancellation or rescheduling fee is charged only if mediation is cancelled or rescheduled within seven (7) business days prior to the scheduled mediation. A cancellation fee equal to one party’s mediation fee will be charged to the party or parties cancelling. In the case of more than one party cancelling, the parties cancelling will pay the cancellation fee on a pro-rata basis.
At the mediator’s discretion, and in appropriate circumstances, such as when we are able to schedule another mediation during the allotted time, or cancellation is caused by matters beyond the control of parties, such as
weather, sickness or settlement, we may waive the cancellation fee.
